Official Rules and Conditions
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
2. ELIGIBILITY: The AOL GSN World Series of Blackjack Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States and the District of Columbia, 21 years of age and older. Void in Puerto Rico and where prohibited. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and the respective household members, of America Online, Inc. (AOL), Game Show Network, LLC (GSN), their parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies, and Strobe Promotions, Inc., are not eligible to enter. Sweepstakes is subject to all federal, state, and local laws. U.S. law governs this Sweepstakes. Individuals who are excluded from casino facilities for any reason including, without limitation, as a result of a government program or by the Las Vegas Hilton at its discretion, or by the individuals' own request are not eligible to receive a prize.
3. SWEEPSTAKES TIMING: The Sweepstakes begins at 12:00 p.m. Eastern Time (ET) on 1/19/06 and ends 12:00 p.m. ET on 2/08/06 (the "Entry Period").
4. TO ENTER: To enter this Sweepstakes go to www.aol.com/blackjack and complete and submit the online entry form. Entries must be received by 12:00 p.m. ET on 2/08/06 in order to be eligible. Limit one entry per person, per email address, per day. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, incomplete or inaccurate are void. Duplicate entries submitted by the same person or the same email address, on the same day are void. Proof of emailing does not constitute proof of receipt. Entries become the property of the Sponsors and will not be acknowledged or returned. If a dispute results as to the identity of an online entrant, it will be determined that the online entry was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address.
5. WINNER DETERMINATION: Potential winners will be selected in a random drawing on or about 2/09/06 from among all eligible entries received. The random drawing will be conducted by Strobe Promotions, Inc., an independent judging organization. Judges decisions are final on matters relating to this Sweepstakes. Potential winners will be notified by electronic mail or overnight mail and/or telephone on or about 2/09/06. Potential winners will be required to sign an affidavit of eligibility/liability release and where legal, a publicity release, an AOL Appearance & Consent Form, and Federal and State tax release, and return these documents, properly executed, via fax within 48 hours and via overnight mail, within 3 business days of issuance of notification. Non-compliance within this time frame, or if prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize will be awarded to a potential alternate winner, time permitting. Odds of winning depend upon the number of eligible entries received. Limit one prize per person/family/household.
6. PRIZE DESCRIPTION: Eight (8) Grand Prizes: an 8-day/7-night trip for the winner and one (1) guest to Las Vegas, NV on February 26, 2006 through March 5, 2006 including round-trip coach class air transportation for winner and guest from major gateway airport nearest winner's home, round-trip ground transportation via private sedan service between winner's home and gateway airport, round-trip ground transportation via private sedan service between airport and hotel in Las Vegas, 7 night's hotel accommodations (double occupancy) at the Las Vegas Hilton (or similar), a ¡§Welcome¡¨ dinner for winner and guest at a restaurant located within the Las Vegas Hilton (or similar), a $1,000 food allowance, and an opportunity for the winner to participate in a mini-tournament in which the two (2) highest scorers (as determined by GSN in accordance with the rules of the mini-tournament) will be awarded a seat in GSN's World Series of Blackjack. Approximate Retail Value (ARV) of each Las Vegas Trip: $5,196. Total ARV of all prizes: $41,568. Actual ARV may vary based on winner's point of departure and existing rates at time of travel. Winner and guest must sign travel release prior to traveling. Prize must be taken on dates specified by Sponsors or prize will be forfeited and an alternate potential winner may be selected at Sponsors' sole discretion. Winner and guest must possess valid ID in order to travel. Air transportation will be provided only if winner resides more than 100 miles from Las Vegas, NV. Winner's guest must be 21 years of age or older, and winner and guest must travel on the same itinerary. All taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the winners. Prizes may not be transferred, substituted or redeemed for cash, except at the Sponsors' sole discretion. Sponsors reserve the right to substitute a prize of equal or greater value if advertised prize is unavailable at the time the prize is awarded. All prizes claimed will be awarded. Any depictions of prizes in advertising or promotional materials for the Sweepstakes are for illustrative purposes only. If any part of the event is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, the remaining components of the prize will be awarded and Sponsors' obligation to the winner will be fulfilled, and no other additional compensation will be provided. Winner's guest must sign and return a liability release and (where legal) a publicity release prior to ticketing of prize. In order for an eligible winner to be awarded a seat on the World Series of Blackjack, such winner must promptly sign and deliver to GSN all applicable contestant paperwork, including, without limitation, a Depiction Release and a Contestant Agreement and Release from Liability, and agree to participate in on-camera interviews and such other activities as may be requested by GSN.
7. CONDITIONS OF PARTICIPATION: By entering, entrants agree to be bound by these Official Rules including all eligibility requirements. By accepting a prize, winner consents to the use of his/her name, address (city and state only), image, likeness, photograph, voice, and biographical material throughout the universe in perpetuity by any and all means, media, devices, processes and technology now known or hereafter devised (including, without limitation, print, broadcast, Internet and portable media) for advertising, publicity and promotional purposes and in connection with the production, distribution, exhibition, promotion, advertising and exploitation of the World Series of Blackjack by Sponsors, and/or any party designated by the Sponsors, including but not limited to, any online announcements, without notice or additional compensation, except where prohibited by law. Entrants release and hold harmless AOL, GSN, their parent and subsidiary companies, affiliates, agencies, Strobe Promotions, Inc., The Promotional Edge and their employees, officers, directors and shareholders ("Releasees") from any claims, actions, injury, loss or damage of any kind, including but not limited to, personal injury or death, resulting from participating in this Sweepstakes or from the acceptance, possession, or use or misuse of any prize awarded or participation in any prize-related activity.
8. GENERAL: Sponsors will collect information from the entrant solely for the purpose of the prize drawing and to notify winners. Sponsors will not share this information with any third parties, except as necessary for the administration of the Sweepstakes. Releasees are not responsible for lost, late, illegible, misdirected, postage due or stolen entries or transmissions, or problems of any kind, including but not limited to printing errors, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website or submit an online entry form, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by the Sponsors, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Entry materials that have been tampered with or altered are void. Sponsors reserve the right, in their sole discretion, to cancel or suspend part or all of this Sweepstakes at any time without notice, if in the judges' opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if virus, bugs non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Sweepstakes. In such event, Sponsors may void any entries they suspect are at issue and award prizes in a random drawing from among all eligible entries received up to the date of cancellation. Caution: Any attempt by an entrant or any other individual to deliberately damage the website or any online service related to this promotion or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsors reserve the right to seek damages (including attorney's fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsors' failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsors reserve the right to disqualify entrants who violate the rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsors reserve the right to terminate that entrant's eligibility to participate in the Sweepstakes.
9. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
10. WINNER'S LIST: To obtain the names of the winners, available after 3/01/06, mail a self-addressed, stamped envelope by 3/31/06, to: World Series of Blackjack Winners, c/o Strobe Promotions, 535 S. Broadway, Suite 203, Hicksville, NY 11801. Residents of VT may omit return postage.
11.
